Founding partner, George V.C. Muscato, a 1972 graduate of Akron Law School, began his private law practice in 1977 in an office at 250 S. Transit Road in Lockport. The firm relocated in 1981 to offices at 188 East Avenue, where it remained until the doors opened to the newly constructed building at 107 East Avenue in 1987. Muscato was joined in 1989 by P. Andrew Vona, a 1985 graduate of Syracuse University Law School. The Partnership of Muscato, DiMillo & Vona, LLP was officially formed in 1994, and has continued to flourish at 107 East Avenue for over nineteen years.

The partners are joined by Associate attorney Amy M. Taylor, Esq. The administrative staff at Muscato, DiMillo & Vona is knowledgeable and experienced, as our legal assistants average over thirty years of working together to effectively manage our office.

Mr. Muscato is a former Niagara County Assistant District Attorney and a frequent lecturer on legal topics, as well as the former President of the Lockport Board of Education, and is currently Chairman of the Board at Eastern Niagara Hospital. Mr. Muscato has been a member of the New York State Bar Association, Lockport Bar Association, and Niagara County Bar Association.

Personal Injury - Do I have a case?

The first thing that many individuals wonder when they are hurt in an accident is if they have a legal claim. It is often difficult to parse through the specifics of a case to understand who might be at fault and whether a third-party acted inappropriately such that they will be held accountable, in full or in part, for the harm caused.

Of course it is impossible to say with certainty whether one has a legal claim without knowing details about the situation. However, in general, the civil law holds that one who is injured (or their surviving family members) has a legal claim for recourse any time that another party intentionally or negligently causes harm. Intentional misconduct is obvious: the other party causes harm on purpose. Negligent misconduct is much more nuanced, but in general it refers to situations where someone acts unreasonably.

Who can get child support?

A person who has physical custody of the children for more than half of the time can usually get child support from the other parent. Child support is ordered by the Family Court, or in the Supreme Court as part of a divorce case.

If the parents share physical custody 50/50, there should still be a child support order, but it is more likely that the court will order an amount that is different than the standard amount set by the child support guidelines.

What paperwork do I need to complete to file for divorce?

Obtaining a divorce in New York is very complicated and involves filling out and filing many court forms, even if your divorce is uncontested. All of the forms you will need to obtain an uncontested divorce are available on the New York Courts website in the Uncontested Divorce Packet, which also includes instructions.

The first form you will you have to fill out is the “Summons With Notice (Form UD-1)” or the “Summons (Form UD-1a)” and “Verified Complaint (Form UD-2).” The Summons is the form that begins your divorce action in Supreme Court and names you as “plaintiff” and your spouse as “defendant.” For more information Contact Us Today

How do I protect a business name?

Though you can register a DBA or Partnership at the County Clerk's Office, it is sometime best to protect your business and business name by registering one of the following:


• Limited Liability Company - A Limited Liability Company is an unincorporated business organization of one or more persons having limited liability for the contractual obligations and other liabilities of the business, other than a partnership or trust. • Corporations - A corporation is an entity separate and distinct from the individual(s) who own and manage the business. A corporation can sell, buy, and inherit property in its own name and is legally endowed with rights, powers, and duties in the conduct of lawful activities. Business corporations operate for profit and can raise capital by selling shares of interest in the corporation. A corporation's debts and obligations are distinctly its own. • S Corporation - Under Section 1362 of the Internal Revenue Code, certain small business corporations may report income on personal tax returns. What is the role of a lawyer when buying any business?
